Spain’s 100% Property Tax Never Became Law. What Foreign Buyers Should Check Instead

The headline suggested that a €250,000 Spanish property could come with another €250,000 tax bill. The measure was never enacted, and the bill lapsed when Parliament was dissolved.

Spain’s proposed 100% property tax sounded dramatic enough to stop an overseas buyer mid-search. A €250,000 home could appear to become a €500,000 commitment overnight.

But that is not the law in Spain.

As of 7 November 2026, the measure has not been enacted. The bill that contained it lapsed after Spain’s Parliament was dissolved on 6 October. No replacement bill has been introduced and no publication in the official state gazette has brought the tax into force.

The proposal still matters because it revealed the direction of Spain’s housing debate. It should be treated as policy risk, not inserted into today’s purchase calculation as a current tax.

What did the proposal actually say?

The measure appeared in a Socialist parliamentary bill introduced in May 2025. It proposed a new complementary tax on certain Spanish property purchases by individuals and companies that were not resident in the European Union.

That wording is important. The test was based on residence, not simply on the passport held by the buyer. The text referred to non-EU residents and did not include a separate exemption for residents of the wider European Economic Area.

The planned rate was 100% of the taxable base, but the transfer tax already paid under Spain’s existing ITP and AJD system would have been deducted. The taxable base would generally have followed the property’s official reference or market value, unless the declared price or consideration was higher.

The bill was also broader than the most common headline suggested. It referred to Spanish real estate, not only homes, and covered the creation or transfer of certain property rights. At the same time, a typical new-build purchase subject to VAT would generally have fallen outside this new taxable event. VAT-exempt transactions could still have been caught.

In other words, even the proposed rule was not a simple tax on every non-EU citizen buying any Spanish home.

    Why did it disappear?

The proposal never completed its first parliamentary stage. The official Congress record still showed it awaiting consideration when the legislature ended.

Spain’s official gazette published the decree dissolving both chambers on 6 October 2026. Congress explains that pending initiatives expire when Parliament is dissolved, apart from limited exceptions that did not apply here.

That means the proposal did not merely remain stuck in debate. It lapsed without becoming law.

A future government could revive the idea in a new bill. Spain’s general election is scheduled for 29 November, and the new chambers are due to meet on 23 December. Any renewed measure would therefore need a fresh legislative process, with wording that could differ from the expired proposal.

What should a foreign buyer calculate now?

Start with the costs that legally apply to the actual transaction. These depend on the region, the property type, whether the purchase is a resale or new build, and the buyer’s own circumstances.

Then test the investment itself. What rent is realistic? Which letting use is allowed? What will management, maintenance, tax and vacancy remove from the headline return? Our guide to the hidden costs of buying property in Europe explains why the purchase price is only the first line of the calculation.

Policy risk belongs in a separate scenario. A buyer close to completion should check whether a proposed change could affect the transaction before signing. A longer-term investor should also consider how future restrictions might influence demand and the eventual resale market.

This is the same distinction we use in the PFC Immobilieninvestor-Index: costs currently in force belong in the base case, while political proposals belong in the risk assessment.

    The useful conclusion

Spain’s 100% tax was a political proposal, not a line on today’s completion statement. Its collapse does not automatically make every Spanish property attractive, just as the original headline did not make every purchase impossible.

The opportunity lies in separating the real transaction from the political noise. Calculate the rules that apply now, keep future policy risk visible, and let the specific property decide whether the investment works.
